These terms and conditions apply to all offers and orders of digital products offered for sale on www.graduatedtravelers.com. Making use of an offer or placing an order (i.e. downloading free or paid products) through the Graduated Travelers (trading name of Trenchic) ​​website constitutes your acceptance of these terms and conditions of sale.

Article 0 – Definitions

In these terms and conditions:

0.1 Reflection time: the term within which the consumer can make use of his right of withdrawal;

0.2 Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur;

0.3 Day: calendar day;

0.4 Duration Transaction: a distance contract with regard to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;

0.5 Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed to him personally in a way that allows future consultation and unaltered reproduction of the stored information.

0.6 Right of withdrawal: the possibility for the consumer to waive the distance contract within the cooling-off period;

0.7 Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;

0.8 Distance Agreement: an agreement whereby, within the framework of a system organized by the entrepreneur for the distance sale of products and/or services, exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the agreement;

0.9 Technology for remote communication: means that can be used to conclude an agreement, without the consumer and entrepreneur coming together in the same room at the same time.

0.10 Terms and Conditions: the present General Terms and Conditions of the entrepreneur.

Article 1 – Offers, prices and payments

1.1 The stated prices for the products and services offered are in euros and include 21% VAT.

1.2 Payment for the digital products offered on www.graduatedtravelers.com is made online and via the payment methods offered. The product is delivered digitally and after successful payment via email or made accessible online.

1.3 By placing an order and paying for a digital product, the buyer enters into a final purchase agreement with Graduated Travelers. The terms of this agreement are available at www.graduatedtravelers.com before and at the time you order any product. You must also accept these terms and conditions during the ordering process.

1.4 Definitive agreement gives the buyer the non-exclusive and non-transferable right to use the digital products. Intellectual property and legal authorship remain with Graduated Travelers at all times.

Article 2 – Intellectual property rights

2.1 All intellectual property rights concerning digital products, both in whole and in part, remain the property of Graduated Travelers. You undertake to refrain from any act that infringes intellectual property rights.

2.2 Graduated Travelers guarantees that the digital products delivered to you do not infringe any intellectual property rights of third parties.

Article 3 – Liability and Responsibility

3.1 Graduated Travelers is not liable for damage that may result from the use of the relevant products.

3.2 Correspondence and/or delivery takes place via email and the internet. You are responsible for providing the correct (email) address to Graduated Travelers. In addition, you are also responsible for correctly setting up your PC and any programs present, such as firewalls, spam filters and virus scanners, so that messages and digital products sent to you can be received.

Article 4 – Copyright and unauthorized use of downloads

4.1 The digital products of Graduated Travelers are copyrighted. It is therefore not permitted to copy and/or distribute and/or commercially exploit the purchased digital products.

4.2 You are not allowed to create “derivative works” by modifying the downloads and then distributing or commercially exploiting them.

Article 5 – Cancel order

5.1 There is no right of return on digital products from Graduated Travelers. Cancellation of already executed and delivered order is not possible for this reason.

Article 7 – Miscellaneous 

6.1 If one or more of the provisions of these Terms and Conditions conflicts with any applicable law, the relevant provision will lapse and will be replaced by a new comparable provision to be determined by Graduated Travelers.

6.2 These terms and conditions are exclusively governed by Dutch law.

6.3 All disputes between the parties will be submitted exclusively to a competent court in the Netherlands.
